Please read and understand these terms and conditions carefully before you access to the website and/or use the Services therein. Use of Shimanto Bank Internet-Banking Service is subject to the following terms and conditions which set out the general rights and obligations of the User/s and Shimanto Bank PLC. In connection with the use of Shimanto Bank PLC. Internet-Banking Service.

 For the purpose of this document, “Internet-Banking Services” refers to the Internet Banking services provided by “Shimanto Bank” PLC through internet or e[1]commerce banking such as balance enquiry, utility bill payment, fund transfer within the accounts of Shimanto Bank PLC. , Other Schedule Bank Accounts, third party Account maintained by Shimanto Bank or any other transfers services etc. Or other services as may be made available by the Shimanto Bank PLC. From time to time.

“User”, “he/she” and/or “his/her” means Shimanto Bank PLC. 'S bank account holder/s registered to use Internet" "Banking. “Shimanto Bank” means Shimanto Bank PLC. , a company duly incorporated under the Companies Act 1994 and a scheduled banking company licensed under the Banking Companies Act, 1991, having its Corporate Head Office at Road No# 02, Bir Uttam M.A. Rob Sarak, Shimanto Square, Dhanmondi, Dhaka – 1205; and its branches or its assigns in respect of which the service will be available.

These Terms and Conditions (hereinafter referred to as Agreement), unless otherwise amended and notified by the Bank from time to time, set out the rights and obligations of you as the customer, and us as the Bank, in connection with your use of the services under Internet-Banking (HEREINAFTER ALSO REFERRED TO AS THE 'SERVICES HEREIN') and your access to the https://connect.shimantobank.com which is an Internet Banking Service provided by Shimanto Bank to its eligible customers, in order to enable them to electronically access and use their Accounts and other banking facilities, products and services as made available by Shimanto Bank.

Privacy Policy 

This privacy policy (the “Privacy Policy”) sets out how we will use and handle customer’s data, including any data collected. This Privacy Policy may change at any time in the future and Customer’s continued access to or use of this shall mean that Customer agrees to the changes.

Use of location data

Certain services, including the locator, use information about the customer’s physical location sent from the customer’s device.

If the Customer uses these services, the Customer consents to us, our partners and licensees, and Google accessing, monitoring, transmitting, collecting, maintaining, disclosing, processing, and using the customer’s location data to enable us and Google to provide the relevant functionality by the Terms and Conditions and Privacy Policy of this and those of Google.

When a customer uses the Shimanto Bank PLC Locator service for the first time, he or she will be asked if he or she is okay with the bank using location services.

The customer may withdraw this consent at any time by turning off the location services settings on the customer’s device.

Use of making and managing phone calls

This service allows Customers to call Shimanto Bank PLC helpline, and others partners. Standard call rates of the customer’s mobile operator shall apply.

 

1. APPLICATION FOR SHIMANTO BANK INTERNET-BANKING:

1.1. The User shall apply to Shimanto Bank in the prescribed form for use of Internet-Banking Services subject to the terms and conditions stated herein including any other terms and conditions as modified or inserted by Shimanto Bank from time to time. Shimanto Bank at its sole discretion may accept or reject any such applications. Once the application is accepted by Shimanto Bank, these Terms & Conditions shall form the contract and govern the relationship between the User and Shimanto Bank in relation to use of Internet-Banking Services. 1.2. By applying for Internet-Banking for the first time, the User acknowledges and accepts these Terms & Conditions. Notwithstanding anything contained herein, all Terms & Conditions pertaining to the accounts shall continue to apply. In the event of any conflict between these Terms & Conditions and the Rules and Regulations governing the User(s) account with Shimanto Bank, these Terms and Conditions shall prevail with regard to Shimanto Bank Internet-Banking.

2. INTERNET-BANKING USERS LOG IN ACCESS, PASSWORD & SECURITY PROCEDURES:

2.1. Shimanto Bank will provide the User with unique User Identification Number (“User ID”) and a temporary Password in the first instance through email. The User/s hereby authorizes and instructs Shimanto Bank to email him/her the User ID and Password relating to his/her access/log-in to the Internet-Banking Services to the email address given in the application at his/her own risk and responsibility. The User shall not be liable for any non-delivery or miss delivery of User ID or Password unless such non-delivery is caused due to willful misconduct of the Bank.

2.2. The User shall log in to the Internet-Banking by using the User ID and Password. As a safety measure, the User shall immediately change Password upon his/her first login. User is requested to change his/her Password frequently thereafter to avoid any possible hacking, inherent risk or misuse/fraudulent use of his/her account. For safety reason it is requested that USER shall use both upper and lower case letters along with numbers and punctuations only understandable by the USER.

2.3. The User acknowledges that the Login ID (User ID) and the Password shall act as User's authorized signature. This signature authorizes and validates directions given just as an actual written signature does.

2.4. User is therefore responsible for maintaining the confidentially and secrecy of User ID and Password. User should not under any circumstances disclose his/her User ID and/or Password to anyone, including anyone claiming to represent the Bank or to someone giving assistance on a technical helpdesk in connection with the service. It is clearly understood that Bank employees do not need Password for any reason whatsoever. Bank shall not be held liable in any manner or in any form whatsoever in case of any unauthorized or fraudulent use of the User’s account through Internet-Banking Services or for loss, misplace or fraudulent use of the User ID and Password.

2.5. If User gives or shares his/her Password to anyone or fails to safeguard its secrecy, he/she does so at his/her own risk because anyone with User Password will have access to his/her accounts.

2.6. If User forgets the Password, he/she has to request for issue of a new password by request to Shimanto Bank Call Center.

2.7. If User’s password is lost or stolen, or is known by another individual, he/she must notify Shimanto Bank Call Center in immediately. Shimanto Bank Call Center upon verification of the request from the User shall at the earliest stop operation of the Internet-Banking Services of the respective User account. If bank receives any information orally or in written from anyone including the user, bank may immediately suspend the services in good faith for the safety and security of the user.

2.8. The User agrees and acknowledges that Shimanto Bank shall in no way be held responsible or liable if the User incurs any loss as a result of information being disclosed by Shimanto Bank regarding his Account/s or carrying the instruction of the User pursuant to the access of the Internet-Banking and the User shall fully indemnify and hold harmless Shimanto Bank in respect of the same.

2.9. User hereby acknowledges and understands the inherent risk of using Internet and availing the Internet-Banking Services and accordingly shall take all necessary precautions at his/her end to safeguard him/her from such risk. Bank shall not be held liable in any form whatsoever if the User suffers any loss or damages due to such inherent risk of internet and Internet-Banking Services unless such loss or damage is caused due to willful negligence of the Bank.

3. SERVICE SOFTWARE & HARDWARE REQUIREMENTS

3.1. User is solely responsible for the maintenance, installations and operation of Users computer/cell phone and for the software/app used in accessing Internet-Banking.

3.2. Shimanto Bank shall not be responsible if the Internet-Banking System does not work properly or the service is interrupted due to failure of electronic or mechanical equipment or communication lines, telephone or other interconnect problems, normal maintenance, unauthorized access, theft, operator errors, severe weather, earthquakes, floods and strikes, or any other causes beyond the reasonable control of the Bank.

3.3. To access Internet Banking Service on mobile phone, the Customer must register with Mobile Network Operator before the commencement date.

3.3. The Customer will be solely responsible for obtaining the prescribed cell phone and the Connection to the Mobile Network Operator and any related costs or expenses will be borne by the Customer.

4. CUSTOMER RESPONSIBILITIES AND UNDERTAKINGS

4.1. The Customer acknowledges that smartphones and other web enabled devices, including the Mobile device used to access Internet Banking Service on mobile phone, are subject to the same security risks as computers that are attached to the Internet and agrees that it is the Customer’s Responsibility to maintain anti-virus and anti-spyware programs on his/her mobile device. The Customer also agrees not to use a mobile device that has been altered from the original factory settings. This type of altering is commonly referred to as “Jail Broken” or “unlocked”. Customer also acknowledges that Shimanto Bank in no way be held responsible if the Customer’s device i.e. Computer or mobile device is affected with virus while accessing the internet banking services.

4.2. The Customer agrees to exercise caution when utilizing the Internet Banking Service on mobile Phone on his/her mobile device and to use good judgment and discretion when obtaining or transmitting information. Any losses, charges and unauthorized transactions involving his/her accounts that are incurred through loss of his/ her mobile device or his/her failure to safeguard the security credentials he/she uses (such as user names and passwords) to access the Internet Banking Service on mobile phone will remain his/her responsibility.

4.3. Should the cell phone requirements be modified with a view to improving or upgrading the Internet Banking Service on mobile phone, the Bank shall in no way be responsible for the resultant costs of any new cell phone or service provider connection required so as to use the Internet Banking Service on mobile phone, and any such resultant costs will be for the Customer’s own account.

4.4. In the event that the Customers experience connectivity or other access related difficulties the Cell phone and / or Mobile Network Operator, it is the Customer’s responsibility to liaise with the Mobile Network Operator and attempt to find a solution to the relevant problem prior to contacting the Bank.

4.5. By participating in the Internet Banking Service on Mobile Phone the Customer agrees that the Internet Banking Service on mobile phone may require the use of his/her mobile device’s data and text messaging capabilities and that standard data and text messaging charges apply in accordance with his/her service agreement with his/her mobile service provider. The Customer agrees that Bank is not responsible for any charges he/she may incur while using the Internet Banking Service on mobile phone.

5. CHARGES:

5.1. Shimanto Bank shall initially provide the Internet-Banking Services at free of cost. However, Shimanto Bank reserves the right to change and recover from the User(s) service charges, as may be fixed by Shimanto Bank from time to time. The User hereby authorizes SHIMANTO BANK to recover such charges from his/her account(s). 5.2. Charges are subjected to change from time to time at Shimanto Bank’s discretion.

6. UNAUTHORIZED/ FRAUDULENT ACTIVITIES:

6.1. Upon obtaining User ID and Password, User is requested to check the list of his/her accounts with Shimanto Bank. If any of User account is missing, please inform this to Shimanto Bank immediately. If a third party account is linked to User’s ID, please inform this to Shimanto Bank also. Do not access it or do not perform any transaction on that account. Such activity, if done, will be treated as fraudulent activity.

6.2. If User believes unauthorized transactions are being made with his/her account, he/she should change the Password immediately and notify the Shimanto Bank.

6.3. The User should check the Statements for all of his/her accounts for any unauthorized transaction. In case of any discrepancy in details of any transactions carried out in respect of the account, in that event User should immediately inform Shimanto Bank Call Center.

6.4. Bank’s only responsibility would be to use its best efforts to prevent such unauthorized transaction if already not been made.

7. ON-LINE FUND TRANSER:

7.1. User shall be responsible for all transfers transactions. Fund Transfer can be made within same user accounts, User account to another accounts held within Shimanto Bank and User account to any schedule bank customer accounts through BFTN.

8. UTILITY BILL PAYMENT

8.1. The Utility Bill Payment services is only available to Users of the Shimanto Bank Internet-Banking Service and shall cover all the utility bill payments of different utility service provider/s (Billers) as mutually agreed between Shimanto Bank and the utility service provider/s.

8.2. The User should accept that he/she will be responsible for putting in the correct account number and transaction amount for the fund transfer request. In such case, Shimanto Bank will not be liable for any erroneous transactions incurred arising out of or relating to the User entering wrong account number and amount.

8.3. Upon Shimanto Bank decision, there will be a transaction amount limit though internet banking. Maximum amount of transaction limit can be subject to change from time to time at Shimanto Bank’s discretion.

8.4. Any transaction made after working hours or on public/bank holidays, the transaction value date will be the next working day.

8.5. No transaction is allowed from a non-convertible taka account to a convertible account.

8.6. In addition to the terms and conditions stated above, the existing policy of the Bank (including amendments from time to time) regarding Bill Collection shall also be applicable for Bill Collection so far it does not contradict with the provisions stated herein. The policy of the Bill Collection shall be available from the branches of the Bank.

8.7. Payment amount must be accurate as per the Bill. Any less payment or higher payment is the sole responsibility of the User and the Bank shall not held liable for any losses, damages or disconnection of utility services due to payment of less amount or whatsoever.

8.8. This agreement does not bind Shimanto Bank as an agent of Utility agency. Shimanto Bank shall not be held responsible for disconnection of the utility service for any reason by the utility service provider.

9. MAINTENANCE OF SUFFICIENT FUND:

9.1. The User shall ensure that there are sufficient funds (or prearranged credit facilities) in his/her account for transactions through the Internet-Banking. All instructions of the User shall be carried out subject to sufficient fund in the respective accounts.

9.2. Shimanto Bank shall not be liable for any consequences arising out of its failure to carry out the instructions due to inadequacy of funds.

10. ANTI MONEY LAUNDERING:

10.1. User should agree and confirm that he/she will not use this Internet-Banking facility for money laundering, illegal, unlawful purpose.

10.2. User shall fully comply with the laws related to the money laundering and shall not use the Internet-Banking services for any anti-terrorism or anti-state activities.

10.3. Shimanto Bank reserves the right to demand explanation from the User regarding any matter pertaining to money laundering and anti-terrorism law of the country.

11. PROPRIETARY RIGHTS:

11.1. The User acknowledges that the software underlying the Internet-Banking as well as other Internet related software which are required for accessing Internet-Banking is the legal property of the respective vendors or Shimanto Bank as the case may be.

11.2. The permission given by Shimanto Bank to access Internet-Banking will not convey any proprietary or ownership rights in such software.

11.3. The User shall not attempt to modify, translate, disassemble, decompile or reverse engineer the software underlying Internet-Banking or create any derivative product based on the software.

11.4. User shall keep all information whether of the User, Shimanto Bank or any other third party/customer derived from the Internet-Banking Services strictly confidential and shall not disclose to any third party without prior written consent of Shimanto Bank.

12. GOVERNING LAW:

12.1. These Terms and/or the operations in the Accounts of the User shall be governed by the Laws of Bangladesh, in force.

12.2. Shimanto Bank may, in its absolute discretion, commence any legal action or proceedings arising out of breach or violation of any of the Terms for Internet-Banking in any other court, tribunal or other appropriate forum irrespective of the place from where the User access the Internet-Banking Services, and the User hereby consents to that jurisdiction.

12.3. Any provision of the Terms for Internet-Banking which is prohibited or unenforceable in any jurisdiction shall, as to such jurisdiction, be ineffective to the extent of prohibition or unenforceability but shall not invalidate the remaining provisions of the Terms or affect such provision in any other jurisdiction.

13. FORCE MAJEURE:

13.1. If for any reason beyond its control including but not limited to system error, network problem, strikes, labor disputes, accidents, governments requisition, restrictions or regulations on travel, hospital operation, political disturbances, acts of war, acts of God, which may hamper to provide regular and normal service and unable to perform its obligations under this agreement, that case Shimanto Bank shall not be responsible at anymore.

14. CHANGES OF TERMS:

14.1. SHIMANTO BANK shall have the absolute discretion to amend or supplement any of the Terms at any time and will attempt to give prior notice of fifteen days for such changes wherever feasible. Such change to the Terms shall be communicated to the User. By using any new services as may be introduced by Shimanto Bank, the User shall be deemed to have accepted the changed Terms. TERMINATION ON INTERNET-BANKING:

14.2. The User may request for termination of the Internet-Banking any time by giving a written notice of at least 30 days to Shimanto Bank. The termination shall take effect on the completion of the fifteenth day. However, the User shall always be held liable for all accrued obligation or instruction given before or on the effective date of termination.

15. UNAUTHORIZED TRANSACTION AND ERROR RESOLUTION:

15.1. If Customer believes unauthorized transactions are being made from Customer’s Account, Customer should change the Internet-Banking Password immediately and notify the Bank.

15.2. If Customer finds any periodic statement wrong or wants to have more information about a transaction or if Customer regards the Bank executes his/her instructions incorrectly, he/she should contact the Bank in writing or over telephone within ten (10) business days. Otherwise, the Customer will be deemed to accept the unauthorized transactions, wrong statements and Bank’s incorrect execution of the instructions and take all the liabilities.

15.3. For this purpose, Customer is reminded that he/she should check all bank statements for any unauthorized transactions.

15.4. The Bank will inform Customer the results of the Bank’s investigation within ten (10) business days on receipt of the Customer’s notification and will correct the error (if any) promptly. If the Bank needs more time to investigate, it will inform the Customer accordingly and may take up to ninety (90) days.

16. COMMUNICATIONS

16.1. Any complaints in connection with the Services should be directed to the Bank’s Call Center as described above. 16.2. Except for the Bank’s Call Center, Customer can also notify the Bank by visiting any Bank branch where he/she opened an account. 16.3. If the bank needs to send the Customer a notice, it will use the address Customer has provided most recently to the Bank.

17. RECORDING CUSTOMERS’ CALL AND INSTRUCTIONS

To protect both the Bank’s customers and its staff, and to help resolve any disputes between customer and the Bank, Customer authorizes and acknowledges that:

17.1. The Bank will record all telephone conversations between the Bank and Customer for the Services; and The Bank will keep a record of all instructions given by the Customer via the Services; and The Bank may listen to telephone calls made in respect of the Service in order to assess and improve the quality of the Services.

18. THE ADVERTISEMENT:

 From time to time the Bank may advertise its own products and services and those of the subsidiary and holding companies of the Bank through the Services. If, in connection with other agreements with the Bank, Customer have asked the Bank not to send him/her any marketing material (or if he/she does so in the future), the customer agrees that this restriction will not apply to these advertisements.

19. BREACH OF TERM & CONDITIONS:

User must compensate for any loss that occurs as a result of his/her breaking any term of these agreements.

I/We hereby acknowledge that I/we have read and understand the terms and conditions for Internet-Banking and the risk involved in Internet-Banking operation and further declare and affirm that by signing below, I/we apply for the Shimanto Bank PLC.  Internet-Banking Services subject to the aforesaid terms and conditions.

I/ We, the Customer agree to Shimanto Bank giving me/ us notice of availability/ readiness of my monthly/ quarterly Statement/s of Account/s via email, to the email address specified by me/us.

Shimanto Bank would be deemed to have delivered the Statement to me/us, immediately on my/ our receiving notice of its availability. I/We will be obliged to download and print the Statement of my/ our Account after receiving notice as aforesaid from Shimanto Bank. Should I/ we experience any difficulty in accessing the electronically delivered Statement, I/we shall promptly advise Shimanto Bank to enable Shimanto Bank to make the delivery through alternate means. Failure to advise Shimanto Bank. Of such difficulty within 24 hours after my/our receiving notice as aforesaid, shall serve as an affirmation regarding the receipt and acceptance by me/us of my/our Statement.

I/ We understand that Internet transmission lines are not encrypted and that email is not a secure means of transmission. I/We acknowledge and accept that such unsecure transmission methods involve the risk of possible unauthorized alteration of data and/or unauthorized usage thereof for whatever purposes. I/ We agree to exempt Shimanto Bank, from, any and all responsibility/liability arising from such misuse and agree not to hold Shimanto Bank. Responsible for any such misuse and further agree to hold Shimanto Bank. Free and harmless from all losses, costs, damages, expenses that may be suffered by me/us due to any errors, delays or problems in transmission or unauthorized/illegal interception, alteration, manipulation of electronic data or otherwise caused by using email as a means of transmission.

I am/ We are aware of all security risks including the risk of the content of my/ our Statement becoming known to third parties,

I/ We agree that I/ We shall not hold Shimanto Bank in any way responsible for the same and agree that the same shall not be considered as a breach by Shimanto Bank. Of banker customer confidentiality.

I/ We undertake to verify the correctness of each statement or report in relation to any transaction and to notify Shimanto Bank within 10 days of dispatch to me/ us of the statement or report or before giving any further instructions thereon, whichever is the earlier, of any discrepancies, omissions or debits wrongly made or inaccuracies in the statement or report so generated. If no objection is made within 14 days or before further instructions are given by the Customer, the same shall be conclusive evidence as against the Customer without any further proof that the statement or report is correct and Shimanto Bank shall be free from all claims in respect thereto.

I/ We understand that I/ We remain fully liable for any of my/ our (customers) contractual liabilities to Shimanto Bank irrespective of receipt or non-receipt of, intimation of availability of my/our Statement. Under no circumstances, including negligence, shall Shimanto Bank. Or anyone involved in creating, producing, delivering or managing my/ our Statement of Account, be liable for any direct, indirect, incidental, special or consequential damages that may result from the use or inability to use the service or out of the breach of any warranty. The use and storage of any information including without limitation, the password, account information, transaction activity, account balances and any other information available on my/ our (the Customers) personal computer is at my/ our own risk and my/ our sole responsibility and liability.

I/ We acknowledge that certain products and services of Shimanto Bank available to me/us require me/us to pay a charge, which will be debited to my/our account/s, and are subject to terms and conditions.

I/ We Understand that Shimanto Bank may withdraw add to or modify the Internet facilities from time to time by notice to me/ us. While advance notice of maintenance work likely to affect the availability of Internet Banking facilities shall be given, Shimanto Bank reserves the right to suspend, upon notice, access to Internet Banking facilities or the provision of all or any of the services at any time if Shimanto Bank deems it necessary to do so in the event of an emergency (the opinion of Shimanto Bank being conclusive in this respect) or for security reasons.

E-mail addresses submitted will be verified by Shimanto Bank. In order to avail the rewards, the e-mail addresses should be valid at the time of verification. In the event of multiple submissions, only the first-mail address submitted will be eligible. E-mail address provided through this program will override prior records. Shimanto Bank Terms and Conditions apply and are subject to change without prior notice. They are available upon request or on the website www.shimantobank.com once you have enrolled, only e-mail statements will be sent.

I/we also have read the entire Terms and Conditions for all Shimanto Bank products and understand that these are subject to change from time to time and accept to be bound by the same and also agree that my acceptance of e-mail statements establishes consent to the Terms and Conditions of Shimanto Bank and specific products covered by these Terms and Conditions.

 

PRECAUTIONARY NOTE:

In order to prevent unauthorized transaction through Internet-Banking Service, Users are advised to strictly maintain the following:

1. The User ID and Password should not be written anywhere accessible to third party including his/her family members.

2. User should make sure that no one is physically watching the passwords when he/she is Logging in.

3. It is important to remember to click 'Log out' after completing his/her Internet-Banking session.

4. User should not leave his/her PC unattended with the browser running and a valid user name and Password cached as in such case anyone can gain access to the account.
